GENERAL TERMS AND CONDITIONS (GTC)

1. Scope and Provider

These General Terms and Conditions apply to orders placed through the online shop operated by:

Hereinafter referred to as “Rattlesnake”, “we” or “us”.

These Terms and Conditions apply to the sale of goods through our online shop to consumers and businesses. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Offer and Conclusion of Contract

The presentation of products in our online shop does not constitute a binding offer. By submitting an order, the customer makes a binding offer to conclude a purchase contract for the goods contained in the shopping cart.

The order confirmation automatically sent immediately after submission of the order initially only confirms receipt of the order. Acceptance of the order takes place by means of an express confirmation of acceptance or by dispatch of the ordered goods.

If an ordered item is exceptionally unavailable, we will inform the customer as soon as possible. Any payments already made for unavailable goods will be refunded.

3. Prices and Shipping Costs

All prices stated in the online shop are in euros and include the applicable statutory VAT unless expressly stated otherwise.

Shipping costs may apply in addition to the product price. The shipping costs applicable to the respective order are displayed to the customer in the checkout before the order is completed.

For deliveries to countries outside the European Union, additional customs duties, import charges, taxes or other fees may apply. These are not charged by Rattlesnake and must be paid by the recipient in accordance with the regulations of the respective country.

4. Payment

The payment methods currently available are displayed to the customer during checkout. Depending on the delivery country and technical availability, these may include credit and debit cards, Shop Pay, Apple Pay, Google Pay, EPS, PayPal and other local payment methods offered through our payment service providers.

There is no entitlement to a particular payment method. The payment methods actually offered during the respective checkout process shall apply.

Payments may be processed by external payment service providers. Their respective terms and conditions may additionally apply.

5. Delivery and Availability

Delivery is available to the countries offered in our online shop and is made to the delivery address provided by the customer.

The applicable delivery times are stated in the online shop, in the product information or in our shipping information. For items expressly marked as “Pre-Order” or “Coming Soon”, the different delivery times stated for the respective product apply.

We make every effort to keep information regarding product availability up to date. Due to delivery delays or unavailability from our suppliers, an ordered item may in exceptional cases not be available within the stated delivery time. In this case, we will inform the customer promptly about the further procedure.

If an order contains items with different delivery times, the items may be shipped together unless otherwise agreed.

6. Store Pickup

Where offered during checkout, orders may also be collected from our store:

The customer will be informed as soon as the order is ready for collection. Collection before receiving this notification cannot be guaranteed.

7. Retention of Title

The goods remain our property until the purchase price has been paid in full.

8. Statutory Right of Withdrawal for Consumers

Consumers entering into distance contracts generally have the right to withdraw from the contract within 14 days without giving any reason, unless a statutory exception to the right of withdrawal applies.

Details concerning the right of withdrawal, the withdrawal period, exercising the right of withdrawal, the consequences of withdrawal and the model withdrawal form can be found in our withdrawal policy published on this website.

During the statutory withdrawal period, an electronic function is also available on our website through which the contract can be withdrawn online (“Withdraw from contract”).

9. Returning Goods Following Withdrawal

In the event of a valid withdrawal, the goods must be returned in accordance with our withdrawal policy to:

The consumer bears the direct costs of returning the goods unless expressly agreed otherwise.

The consumer is only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

10. Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply, in particular, to goods made to the customer's specifications or clearly personalised, as well as to other goods and contracts for which the law provides an exception to the right of withdrawal.

The statutory provisions concerning exceptions to the right of withdrawal remain unaffected.

11. Statutory Warranty Rights

The statutory warranty provisions apply to the goods sold by us.

Consumers have the statutory warranty rights in the event of defects. The statutory warranty period for goods is generally two years from delivery of the goods; under Austrian law, a longer period may apply in certain cases.

The harmonised notice concerning the statutory warranty rights required since 27 September 2026 is provided separately and prominently in the online shop.

Statutory warranty rights are not restricted by any manufacturer's warranty.

12. Product Representation

We make every effort to display our products as accurately as possible. Depending on the screen, device or settings used, colours may differ slightly from the actual goods.

Materials, cuts, sizing and design may vary between products from different manufacturers. The respective product description and the information provided there shall apply.

13. Liability

The statutory liability provisions apply.

Any limitation of liability does not apply where liability is mandatory by law, in particular in cases of damage caused intentionally or by gross negligence and in cases of personal injury.

14. Copyright and Trademark Rights

The contents of our online shop, in particular texts, images, graphics, logos and other representations, may be protected by copyright or trademark law. Any use beyond that permitted by law requires the consent of the respective rights holder.

15. Applicable Law

Austrian law applies, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.

16. Changes to these Terms and Conditions

The Terms and Conditions valid and incorporated into the contract at the time the respective contract is concluded apply to each order.

Changes to these Terms and Conditions do not have retroactive effect on contracts already concluded.
